You literally get prompted to opt-in by your own choice if you want to use the Essential Space, with Terms of Use and Privacy Policy both being very clearly visible for you to read. If you don’t agree with any of that you don’t hit the big yellow button.

Not just that but even on another screen right after you tap “Get started” you get welcomed with this:

So basically double opt-in, you have to do it twice on your own. How can it violate anything if you are well-aware of it and you agree to it?
Plus the fact that it was never advertised as an offline AI, even Carl said it himself that the current tech is still far from being powerful enough to run it all locally (AKA fully offline). It was advertised as an online service where nothing gets stored in cloud/on servers after it’s being processed though.
