My best guess is something wrong with the predictive back gestures and how the touch is registering on the wrong layer. On 3.2 you could just fly around settings as fast as you want, but on 4.0 is feels a bit sluggish at times and you get a phantom touch instead of a gesture which can select or even toggle options.
You can just be slower, but it's a regression from 3.2 and makes me feel slightly worried about accidentally toggling something I didn't mean to.
Hopefully the video shows this - is a few times (especially around 8 seconds in) you can see the back gesture is invoked, but it stops mid way and registered a press instead. Also there is a few occasions where a tap does not do anything at all between layer swaps
